B. Artwork Submission

By the term ‘artwork’ or ‘artworks,’ we refer to one or more digital material in any format and size, whether mounted or unmounted, and intended for any purpose.

For artworks, the term ‘submitted’ encompasses any method of electronic upload or transference to AI-ARTS, of an electronic content, for any purpose.

Submitting an artwork to AI-ARTS does not transfer copyright to AI-ARTS or any other member of AI-ARTS at any time. However, it is an agreement that AI-ARTS can use the artwork(s) as indicated in these Terms & Conditions.

Only members with an active membership are eligible to submit images to AI-ARTS. If you do not agree to these terms and conditions, you must NOT submit your image(s) to AI-ARTS, in any format, or by using any method.

By submitting artworks to AI-ARTS, you acknowledge and agree to the following terms and conditions:

  1. Age Requirement: By submitting your artwork to AI-ARTS, you affirm that you are at least eighteen (18) years of age. This age requirement ensures compliance with legal standards and the responsible handling of content and personal information.
  2. Copyrights: You warrant that you are the rightful owner of the artworks submitted and that the artworks do not infringe upon any third-party copyrights or intellectual property rights. You retain all copyrights and intellectual property rights to your artworks.
  3. Privacy: We respect your privacy and will handle all personal information provided during the submission process in accordance with our privacy policy. Your personal information will only be used for the purpose of the publication of your artworks on the website and will not be shared with third parties without your explicit consent.
  4. Metadata Responsibility: AI-ARTS will not be responsible for any third party accessing the metadata contained within any image(s) you submit. It is your responsibility to ensure that the metadata within your electronic image(s) does not contain or disclose any personal or sensitive information about the copyright owner or any other individual.
  5. Acceptance of Rules: By publishing in AI-ARTS, you agree to comply with all the rules and guidelines set forth by the organisers. Failure to comply with the rules may result in the cancellation of your account on the website.
  6. Participant Warranties: You warrant that all information provided during the submission process is true, accurate, and complete. You further warrant that your artworks are original, and do not contain any defamatory, offensive, or illegal content. You also acknowledge that the decision of the website organisers to publish your artworks is final and binding.
  7. Use Discretion: You understand and acknowledge that submitting an artwork to AI-ARTS does not guarantee its acceptance, use, or publication. The selection and usage of artworks are at the sole discretion of AI-ARTS. Furthermore, by submitting, you agree that your artwork may be made available on AI-ARTS.ORG and to the general public under the specific license granted with its submission. You also understand that AI-ARTS reserves the right to discontinue the use of your artwork at any time, without prior notice to you.
  8. Reproduction Permissions: By submitting your artworks to AI-ARTS, you grant the organisers a non-exclusive, worldwide, royalty-free license to reproduce, display, and promote your artworks on the website, social media, and other promotional materials. This is provided without any form of retribution. The purpose is to promote the website and showcase the artworks, contributing to the visibility and recognition of your creative efforts within the AI-ARTS community.
  9. Liability: AI-ARTS and its affiliates, officers, employees, and agents shall not be liable for any loss, damage, or injury arising from the publication of your artworks in AI-ARTS website or the use of your artworks, including but not limited to, any errors or omissions in the submission process, technical malfunctions, or unauthorised access to your personal information.
  10. Liability for Unauthorised Use: You understand and agree that AI-ARTS is not liable for any unauthorized use of your Submission by third parties. This recognition absolves AI-ARTS of responsibility for any external misuse of the content you provide.
  11. Subject Consent: If any non AI-generated persons (adults or minors) appear in your submissions, you represent that these individuals (the “Subjects”) are aware of and agree to these submissions and terms. You confirm that you have received express consent from the Subjects to include their images in your Submission without any claim or expectation of compensation. Similarly, if non AI-generated animals are included in your Submissions, you affirm that their owners have given express consent for the inclusion of these animals’ images, free of any claim or expectation of compensation.
  12. No Compensation Agreement: You acknowledge that you are not entitled to any compensation in connection with this Agreement or any artworks or other materials submitted to AI-ARTS. You waive all claims against AI-ARTS for any remuneration for your submissions, irrespective of how or whether they are used.
  13. Disqualification: AI-ARTS reserve the right to disqualify any participant who violates the terms and conditions, engages in any fraudulent or unethical conduct, or otherwise disrupts the integrity of the website.
  14. Modifications: AI-ARTS reserve the right to modify, suspend, or terminate the AI-ART Gallery, Directory or the website at any time for any reason, including but not limited to technical issues, force majeure events, or unforeseen circumstances.
  15. Right to Delete: Any image(s) submitted to AI-ARTS, in any format, are considered copies. Accordingly, AI-ARTS reserves the right to permanently delete or destroy any such image(s) at any time after submission, for any reason, without any obligation or liability to you.
  16. Severability: If any provision of these terms and conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  17. Entire Agreement: These terms and conditions constitute the entire agreement between you and the AI-ARTS, and supersede all prior and contemporaneous agreements, understandings, and representations, whether oral or written, with respect to the subject matter of the website and the publication of artworks in the AI-ARTS Gallery.

C. Content Submission

Members of the AI-ARTS community may wish to submit various forms of content for publication across our platforms. These terms and conditions outline the agreement you consent to when you submit content to us, including but not limited to, blogs, comments, graphics, data, images, videos, and other forms of creative expression.

By submitting content to AI-ARTS, you agree and represent that:

  1. You have either created the content yourself, or you have obtained permission from, or are authorised by, the owner of any part of the content for its submission.
  2. While you or the original owner retain copyright of the content submitted, by submitting it to AI-ARTS, you grant us an unconditional, irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide licence. This licence allows us to use, publish, or transmit the content, or authorise others to do the same, in any format and on any platform, whether currently known or developed in the future.
  3. You acknowledge that providing content to us, or viewing content provided by others, is done at your own risk and discretion. This includes reliance on its accuracy, completeness, and usefulness. You also agree that the views expressed in the content do not necessarily reflect those of AI-ARTS, and we neither endorse nor support any content provided by users.
  4. We reserve the right to refuse publication, or to edit, cut, or crop any content at our sole discretion. We may also remove content from our platform at any time.
  5. AI-ARTS accepts no liability for any user-submitted content that is published by us.
  6. You warrant that your submitted content is not obscene, threatening, harassing, deceptive, fraudulent, invasive of privacy, offensive, defamatory, or otherwise illegal. You also warrant that it does not infringe any intellectual property, privacy rights, or other legal rights of any party or individual.

D. Competition Artwork Submission

When submitting artworks to the AI ARTS competition, participants agree to the following terms and conditions, in addition to the general terms of artwork submission:

  1. Eligibility for Submission: Only artworks that comply with the specific guidelines and criteria of the competition, as detailed on our website, will be considered for inclusion. It’s important that each participant reviews these guidelines before submitting their work. Remember, there is a limit to the number of artworks you can submit to each competition, so make sure your submissions align with these established rules.
  2. Originality and Copyright: You confirm that each submitted artwork is an original creation and does not infringe upon any third-party copyrights or intellectual property rights. You retain all copyrights to your artworks.
  3. Use of Artworks: By submitting your artworks to the competition, you grant AI-ARTS a non-exclusive, worldwide, royalty-free license to display, promote, and use your artworks in connection with the competition. This includes showcasing them on our website, social media, and other promotional materials.
  4. Age Requirement: Participants must be at least eighteen (18) years of age at the time of submission.
  5. Artwork Guidelines: Submissions must comply with any specific guidelines set for the competition, including but not limited to, the type of artwork, the theme, the use of AI technology, and any ethical considerations as outlined in our Ethics section.
  6. Discretion and Usage: Please be aware that submitting an artwork to the AI ARTS competition does not assure its acceptance, use, or inclusion in the competition. The selection and utilization of artworks for the competition are solely at the discretion of AI ARTS. By participating, you consent to your artwork potentially being displayed on the AI ARTS website and available to the general public under the specific license accorded with its submission. Furthermore, AI ARTS reserves the right to discontinue the use of your artwork in the competition at any time, without prior notice. This policy is in place to ensure the integrity and dynamic nature of the competition.
  7. Voting and Judging: The submitted artworks will be subject to public voting and evaluation by a jury as part of the competition process. The decision of the jury and the outcome of the public vote are final.
  8. Award Acceptance: Winners agree to the terms of the award as described in the competition details, including the exhibition of their artworks in the AI ARTS Gallery.
  9. Responsibility for Content: Participants are responsible for ensuring that their submissions do not contain any defamatory, offensive, or illegal content.
  10. Right to Modify or Withdraw: AI-ARTS reserves the right to modify the terms of the competition or withdraw the competition at any time due to unforeseen circumstances.
  11. No Compensation: Participants acknowledge that they are not entitled to any compensation for their submissions or for any awards, beyond the recognition and opportunities provided by the competition itself.
